These terms are an agreement between you and Climbing Cat LLC ("we", "us") and govern your use of the Mahjong Versus app ("the app") and its online service. You accept them when you continue past the sign-in screen, which links to them, by playing as a guest or signing in with Apple. Our Privacy Policy explains how we handle your information.
The app itself is licensed to you under Apple's standard Licensed Application End User License Agreement. These terms add the rules for our online service; if the two conflict about the app's licence, Apple's agreement applies.
You must be at least 13 years old, or the minimum age to consent to data processing in your country if that is higher. If you are under the age of majority where you live, your parent or guardian must agree to these terms on your behalf.
The app lets you play Hong Kong–style mahjong online against other players and computer opponents, and offline against computer opponents. In Quick Match and private rooms, a computer opponent may fill any empty seat. Online matches run on our servers; their results, scoring and rule enforcement are decided server-side and are final.
You are responsible for the device and sign-in method used to access your account, and for what happens under it. A guest account is tied to your device; link Sign in with Apple to keep your progress on another device. You can delete your account at any time in Settings → Account → Delete Account.
Mahjong Versus has zero tolerance for objectionable content and abusive players. You agree not to:
You can report a player from a match, your match history, their profile or their friend request, and block them so they can no longer invite you or send you friend requests. You can unblock players in Settings → Blocked Players. We review reports and aim to act on them within 24 hours. If we find a breach of these terms we may remove or change a username, reset progress gained unfairly, or suspend or terminate the account, depending on how serious it is. We may also suspend an account temporarily, without notice, while we investigate suspected cheating, abuse or a threat to the service's security. If you think we got it wrong, email us and we will take another look.
Your username and avatar choice are shown to other players. You give us a worldwide, non-exclusive, royalty-free licence to display them in the service for as long as your account exists, and afterwards in other players' records of matches you played together, which keep the username you had at the time. If you send us feedback or ideas, we may use them without obligation to you.
Experience points, levels, achievements, streaks and any in-game items are for entertainment only. They have no monetary value, cannot be exchanged for money or transferred, and may be adjusted or reset if obtained through bugs or abuse. We may also correct match results, scores, rewards or progression that were affected by a bug, a server error or cheating. The game involves no real-money wagering.
We aim to keep the game online but do not guarantee uninterrupted service. Features may change, and we may discontinue the service; where practicable we will give reasonable notice in the app first. You may stop using the app at any time.
The app, its artwork and its software are owned by Climbing Cat LLC or its licensors. Your right to use the app comes from Apple's standard licence described above; nothing in these terms grants you any other right in them.
To the maximum extent permitted by law, the app is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
To the maximum extent permitted by law, Climbing Cat LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of the app, and our total aggregate liability for all claims relating to the app or the service is limited to the greater of the amount you paid us in the 12 months before the first claim and US$50.
Nothing in these terms limits any right you have under consumer protection law that cannot be waived or limited by contract, including, where you live in the EU or UK, liability for death or personal injury caused by our negligence or for fraud. Where such a law applies, the disclaimer and limitation above apply only as far as that law allows.
To the extent permitted by law, you agree to compensate us for claims, losses and reasonable costs arising from your breach of these terms or misuse of the service.
You can end this agreement at any time by deleting your account and the app. We may suspend or end your access as described under Reporting, blocking and enforcement, or if we discontinue the service. Sections that by their nature should survive (including intellectual property, disclaimer, limitation of liability and governing law) survive termination.
These terms are governed by the laws of California, United States, without regard to its conflict-of-laws rules. Before bringing a claim, please email us so we can try to resolve it informally. Any dispute that can't be resolved that way will be heard in the state or federal courts located in California, and you and we consent to their jurisdiction. If you are a consumer living outside the United States, you keep the protection of the mandatory laws of your country and may also bring proceedings in your local courts.
We may update these terms. For material changes we will update the effective date above and let you know in the app before they take effect. If you don't agree to the updated terms, stop using the app and delete your account; continuing to play after they take effect means you accept them.
If any part of these terms is found unenforceable, the rest stays in effect. These terms, Apple's standard licence and the Privacy Policy are the whole agreement between you and us about the app. You may not transfer your rights under these terms; we may transfer ours as part of a sale or reorganisation of the business. If we don't enforce a term right away, we can still enforce it later.
